INSTAPHYSIQUE, INC. (“InstaPhysique,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the information you share with us.
This Privacy Policy explains how we collect, access, use, disclose, retain, and protect information when you use the InstaPhysique website at www.instaphysique.com, the InstaPhysique mobile application, our online booking and account services, or other services that link to this Privacy Policy (collectively, the “Services”).
By using our Services, you acknowledge the practices described in this Privacy Policy.
1. Information We Collect
Depending on how you interact with InstaPhysique, we may collect the following categories of information.
Personal and Account Information
When you create or maintain an InstaPhysique account, register for a class or service, make a purchase, or communicate with us, we may collect information such as:
- First and last name
- Email address
- Phone number
- Mailing or billing address
- Date of birth
- Account information and preferences
- Emergency contact information, if provided
- Profile information or profile photo, if provided
- Class reservations, attendance, memberships, packages, and purchase history
- Communications with InstaPhysique
Some information is optional unless required to provide a particular service.
Payment Information
When you purchase classes, memberships, wellness services, or other products, payment information is processed by third-party payment processors and our fitness-business technology providers.
InstaPhysique does not directly store full payment-card numbers. We may have access to limited payment information, such as payment status, transaction details, card type, expiration information, or the last four digits of a payment card, as necessary to manage your account and transactions.
Location Information
Our mobile application may request access to location information when necessary to provide location-based functionality, such as identifying or displaying nearby InstaPhysique studios.
You can manage location permissions through your device settings.
Device, Usage, and Technical Information
When you use our website or mobile application, we and our service providers may automatically collect information such as:
- Device type
- Operating system
- App version
- Browser type
- IP address
- Device or other identifiers
- App interactions and usage activity
- Pages or features viewed
- Performance information
- Crash and diagnostic information
- Advertising or analytics information
This information may be used to operate, secure, troubleshoot, analyze, and improve the Services.
2. Health and Fitness Data
The InstaPhysique mobile application offers an optional feature that allows users to connect supported health and fitness services, including Health Connect on Android and Apple Health on iOS, to view certain workout metrics associated with completed InstaPhysique classes.
Health Data We Access
If you choose to enable this feature and grant the requested permissions, the InstaPhysique app may read:
- Heart rate information, used to display average heart rate during an eligible completed class; and
- Active calorie information, used to display active calories burned during an eligible completed class.
The app reads applicable information for the scheduled time period of a completed class in which you participated.
Connecting Health Connect, Apple Health, or another supported health service is entirely optional. The InstaPhysique app does not access this information unless you affirmatively choose to connect the applicable service and grant the requested permissions.
How Health Data Is Used
Health Data accessed through Health Connect or Apple Health is used solely to provide the workout-metrics functionality requested by the user, including displaying applicable workout information within areas of the app such as reservation details, reservation history, or workout statistics.
Health Data Storage and Retention
Health Data accessed through Health Connect or Apple Health for this feature is not stored or retained by InstaPhysique or our mobile-app platform provider.
The applicable heart-rate and active-calorie values are read from the user’s device, displayed to the user within the app, and then discarded.
These Health Data values are not transmitted to InstaPhysique studio staff, are not included in studio analytics, and are not retained in InstaPhysique customer records.
Health Data Sharing and Restricted Uses
InstaPhysique does not sell Health Data.
We do not use Health Data accessed through Health Connect or Apple Health for:
- Advertising or targeted advertising
- Marketing
- Data brokerage or resale
- General analytics
- Determining creditworthiness
- Employment eligibility
- Insurance eligibility
- Any purpose unrelated to providing the health or fitness functionality requested by the user
We do not provide InstaPhysique employees or studio staff access to the heart-rate or active-calorie information obtained through Health Connect or Apple Health.
Managing Health Permissions
You may manage or revoke the InstaPhysique app’s access to Health Data at any time through:
- Health Connect settings on Android;
- Apple Health or applicable device settings on iOS; or
- Other settings provided by your device or connected health service.
If you revoke permission, the InstaPhysique app will no longer be able to access that Health Data and the associated workout metrics may no longer appear in the app.
3. How We Use Information
We may use information collected through the Services to:
- Create and manage your InstaPhysique account
- Allow you to view schedules and studio locations
- Book, modify, and manage classes and wellness services
- Process purchases and memberships
- Maintain reservation and attendance history
- Provide customer support
- Communicate with you regarding your account, reservations, purchases, or services
- Send operational notices and important account communications
- Send marketing communications when permitted
- Personalize and improve the Services
- Analyze use and performance of our website and application
- Diagnose technical problems
- Maintain security and prevent fraud or misuse
- Enforce our agreements and policies
- Meet legal, regulatory, accounting, and compliance obligations
- Carry out other purposes disclosed to you at the time information is collected
- Carry out purposes for which you provide consent
Health Data obtained through Health Connect or Apple Health is subject to the more limited uses described in the Health and Fitness Data section above.
4. How We Share Information
We do not sell your Health Data.
We may disclose other personal information when reasonably necessary to operate InstaPhysique and provide the Services.
This may include sharing information with service providers that perform services on our behalf, such as:
- Mariana Tek and other fitness-business technology providers
- Payment processors
- Website hosting providers
- Cloud infrastructure providers
- Email and SMS communication providers
- Analytics and application-performance providers
- Customer-support providers
- Fraud-prevention and security providers
These providers may access information only as reasonably necessary to provide their services or fulfill the purposes described in this Privacy Policy, subject to their contractual and legal obligations.
Our application may also share certain technical information, such as app activity, application performance information, diagnostics, and device or other identifiers, with service providers that help us operate, analyze, secure, and improve the application.
We may also disclose information:
- When required by applicable law, court order, subpoena, or governmental request;
- To investigate or prevent fraud, security incidents, misuse, or unlawful activity;
- To enforce our agreements or protect the rights, safety, or property of InstaPhysique, our customers, or others;

- When you direct us or consent to the disclosure.
We do not sell or share SMS opt-in information or mobile phone numbers with third parties for their own marketing purposes.

Our website and certain Services may use cookies, pixels, local storage, and similar technologies.

- Understand how visitors use our Services

- Account, membership, booking, attendance, and transaction information may be retained while your account is active and thereafter for a reasonable period when needed for business, legal, accounting, tax, dispute-resolution, fraud-prevention, or recordkeeping purposes.
- Marketing preferences and consent records may be retained as necessary to honor your preferences and document compliance with applicable communication laws.
- Technical, analytics, security, and diagnostic information may be retained for periods reasonably necessary to analyze performance, maintain security, troubleshoot issues, and improve the Services.
- Information subject to a valid deletion request will be deleted or de-identified unless retention is required or permitted by law or is reasonably necessary for purposes such as security, fraud prevention, dispute resolution, or legal compliance.
- Information contained in backups may remain for a limited period until the applicable backup systems are overwritten or deleted through routine retention processes.
Health Data accessed through Health Connect or Apple Health as described in Section 2 is not retained by InstaPhysique or our mobile-app platform provider. Those health values are displayed to the user and discarded.
When personal information is no longer reasonably required, we may delete, de-identify, or aggregate it.
7. Accessing, Correcting, and Deleting Your Information
You may review or update certain personal information through your InstaPhysique account.
You may also request access to, correction of, or deletion of personal information associated with your InstaPhysique account by contacting:
Where account-deletion functionality is available within the InstaPhysique app or online account, you may also use those tools to submit a deletion request.
When you request deletion of your account, we will delete or de-identify associated personal information unless we are required or permitted to retain certain information for legal, tax, accounting, fraud-prevention, security, dispute-resolution, or other legitimate purposes.
Revoking Health Connect or Apple Health permissions can be done separately through your device’s health or privacy settings.
8. Email and SMS Communications
If you have elected to receive promotional emails, you may unsubscribe using the unsubscribe link contained in those communications.
If you have elected to receive marketing text messages, you may opt out at any time by replying STOP to an applicable message.

Even if you opt out of promotional communications, we may continue to send transactional or service-related communications that are necessary to manage your account, reservations, purchases, memberships, safety notices, or other aspects of the Services.
Standard messaging and data rates may apply.
9. Data Security
We and our service providers use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, alteration, loss, misuse, or disclosure.
Personal information transmitted through our Services is protected using appropriate encryption in transit, such as HTTPS or other modern encryption technologies where applicable.
No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and for restricting unauthorized access to your devices and account.
10. Third-Party Services and Embedded Content
Our Services may contain links to, integrations with, or embedded content from third-party websites or services.
Third parties may collect information according to their own privacy policies when you interact with their services. InstaPhysique is not responsible for the privacy practices of third parties that operate independently from us.
Our use of third-party service providers to operate the InstaPhysique Services is otherwise described in this Privacy Policy.
11. Children’s Privacy
The InstaPhysique Services are not directed to children under 15 years of age, and we do not knowingly collect personal information directly from children under 15 without appropriate authorization.
