The following terminology applies to these Terms and Conditions, Disclaimer Notice and any or all Agreements: “Client”, “Member”,“You”, and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “Our” “we” and “Us” refers to INSTAPHYSIQUE, INC. “Party”, “Parties,” or “Us” refers to both the client and ourselves, either the client or ourselves as determined by the context of the sentence. All terms refer to the offer, acceptance or consideration of payment necessary to undertake the process of our assistance to the client in the most appropriate manner, for the express purpose of meeting the client’s needs in respect to the Company’s stated services and products, in accordance with and subject to prevailing California law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same. Our website, https://instaphysique.com, provides users with basic information about us, as well as the ability to book, cancel, and pay for services and products offered at our facilities. The extent of services offered by us are limited to those described on our website, which is hosted in the United States.
GRIP SOCKS REQUIRED
Grip socks are required in all classes for sanitary reasons and for your safety. No exceptions. We sell many sizes and styles at the studio. Regular socks are required for Roll Massage appointments.
FIRST TIME ARRIVAL REQUIRED 10-15 MINUTES EARLY
You must arrive at the studio no later than 10 minutes prior to scheduled class time so you can check in, complete a waiver, get oriented and meet your coach who will give you an introduction to the equiptment and ask about injuries or other concerns prior to class. If you come less than 10 minutes before class, your instructor may not have adequate time to orient you and you may be turned away. The class will be credited back to your account to reschedule for another time.
PURCHASES OF CLASSES, MEMBERSHIPS, SERVICES AND MERCHANDISE
In order to make a class or service reservation, you must first have a class credit or have a series or monthly membership. To buy class credits or a recurring monthly series, you can go to our web site and log into your account (if you do not have an account, you will need to create one). Please note that our class and series prices are subject to change without notice. You can reserve classes up to two weeks in advance for most classes or services. Your credit/debit card will be charged for your order when you submit your purchase. As soon as your charge is approved, your class credits or unlimited monthly series will be available in your account. If you fail to pay any charges when due, INSTAPHYSIQUE reserves the right to suspend or terminate your privileges. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that INSTAPHYSIQUE may incur in its efforts to collect any past due or unpaid balances from you. Class and service credits purchased are not refundable.
RECURRING MEMBERSHIPS: All memberships have an initial term of 3 months or 12 months, commencing on the day the first payment is made. All classes must be pre-paid and are nonrefundable. Memberships with a limited number of classes per month will be credited classes upon each billing cycle. Please note that our class and series prices are subject to change without notice, however as long as You can reserve classes up to two weeks in advance for most classes or services. Your credit/debit card will be charged for your order on its renewal date. As soon as your charge is approved, your class credits or unlimited monthly series will be available in your account.
MEMBERSHIP RENEWAL: Recurring Memberships automatically renew month-to-month after the completion of the initial term length commitment. If you do not wish to continue your current membership after the initial commitment has been met, you must notify us of your wish to cancel by sending an email to [email protected] at least 7 days before your next scheduled payment. All future prices are subject to change without notice.
SINGLE CLASS ADD-ON: For those with a limited number of classes per month, you can “top up” your account by adding single classes at the discounted rate of $24. E-mail [email protected] for your member add -on redemption code or for assistance.
NON-USE: By signing up for a membership, Member acknowledges and agrees that if classes and facilities are not used, Member is not released from the obligation to make all payments required by the terms of this Agreement. Additionally, unused classes cannot be rolled over to the next month.
MEMBERSHIP FREEZE POLICY-You can freeze your membership for the following number of days according to your contract length. E-mail us with dates to activate a freeze. Freezing time on the membership will stop your membership payments during the freeze period. The time of any freeze will extend the current billing period term by the amount of time of the freeze. 12-month contracts: 30-day freeze total; 3-month memberships: -day freeze total.
TERMINATION OF MEMBERSHIP: Clients on recurring memberships are receiving a membership discount on services rendered based on the length of their membership term. In the event the membership is terminated before the initial commitment is met, client is responsible for paying the difference between the full-priced package and the discounted contract package for the number of completed payments made under the contract at time of early cancellation, plus a $250 early cancellation fee. Cancellation Rights: You may cancel your recurring membership if you move more than 25 miles from a InstaPhysique location.You must provide written evidence of your move. You may also cancel your purchase in case of death or disability. InstaPhysique may require verification.
ACTIVE PAYMENT ON FILE REQUIRED: To attend classes at InstaPhysique, we require that you have an active credit or debit card on your account. We will use it only to charge fees and retail, memberships or classes you purchase. If the card is declined or expired, you have 2 days to update it, or the system will suspend or terminate booking privileges until you do.
RETAIL: We sell various items of clothing and accessories at our locations. We accept returns of unused and unworn merchandise within 14 days of purchase for store credit or exchange. We do not offer refunds. Items returned must be unworn or unused and complete with original tags and/or packaging. Allowances will be made for defective or damaged goods if brought to our attention with 14 days of purchase. Items purchased on sale or mark-down are not returnable nor exchangeable.
ALL SALES ARE FINAL & NON-TRANSFERABLE
All sales of memberships, class packs, gift cards, events, trainings and programs are final, non-refundable and non-transferable.
We have a two week booking window. Booking for a new week of classes opens Sundays at 12 PM for the next 14 days
In the event a class is full, try the waitlist — it works! When a spot becomes available before the cancellation window closes, an email confirmation will be sent to let you know. Don’t forget, it is your responsibility to cancel your reservation if you can no longer make it to avoid cancellation penalties. Outside of the cancellation window, keep an eye on the schedule. We will not be able to automatically add you to the class, so grab that spot!
CLASS CANCELLATION & NO SHOW
With limited spots available in and demand for classes, we ask our community to please be mindful of our cancellation policy. We thank you in advance for your cooperation, as it allows all members of the InstaPhysique community the chance to get into classes.
You must cancel using our app or website 12 hours before class time to avoid a penalty.
No texts, emails or calls. No exceptions.
Any class cancellations completed less than 12 hours before class is considered a Late Cancellation and will result in a $18 late cancel fee with the class credit returned to your account for a future booking.
No-Shows: If you do not show up for your reserved class time, you will lose that credit and a $25 no-show fee is incurred.
Thank you in advance for understanding our policy. Our class sizes are small in order to provide you with a personalized experience, and we want to ensure you are able to plan your schedule and reserve your spot ahead of time.
Late Arrivals: Classes start and end on time. Please be on time. We have a 5 minute grace period, at which point your spot will be give to a waitlisted client. You will be held to our late cancel and no-show policies. While we understand life happens, there are no exceptions to this policy.
COACHES & CLASS TIMES SUBJECT TO CHANGE WITHOUT NOTICE
While we try not to cancel classes or switch coaches last minute, things do happen. We reserve the right to cancel classes and change coaches for any reason at any time. Such changes will not result in a refund.
WAIVER & RELEASE
A waiver and release must be signed and on file by every client prior to participating in a class or program at InstaPhysique.
Minors: Before persons under the age of 18 may participate in or utilize INSTAPHYSIQUE’S Classes and Facilities, such person(s) are required to obtain from a parent or legal guardian consent to the following Waiver and Release. Consent shall be in the form of written communication signed by the parent or legal guardian. We do not permit minors under the age of 16 to utilize the Megaformer, InstaRoll or Infrared Sauna.
